1. Acceptance of Terms

By accessing or using Solana Tamagotchi ("Service", "Game", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, players, contributors, or creators of content.

We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

Solana Tamagotchi is a Play-to-Earn (P2E) virtual pet game built on the Solana blockchain. The Service includes:

• Game Platform: Virtual pet simulation game accessible via Telegram bot and web browser
• TAMA Tokens: In-game utility tokens on Solana blockchain (SPL token standard)
• NFT System: 5-tier NFT collection (Bronze, Silver, Gold, Platinum, Diamond) with gameplay utility
• Blockchain Integration: On-chain token minting, NFT minting, and wallet withdrawals
• Mini-Games: Various gameplay activities to earn TAMA tokens
• Referral System: Social sharing and referral rewards

The Service operates on Solana Devnet (testing) and will migrate to Solana Mainnet in Q1 2026. Tokens and NFTs on Devnet have no monetary value and are for testing purposes only.

3. User Accounts & Eligibility

3.1 Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3.2 Account Creation

To use the Service, you may need to:

• Connect via Telegram (OAuth authentication)
• Optionally connect a Solana wallet (Phantom, Solflare, etc.) for withdrawals

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Prohibited Users

You may not use the Service if:

• You are located in a country or region where cryptocurrency or blockchain gaming is prohibited
• You are on any sanctions list or restricted persons list
• You are using the Service for illegal purposes

4. TAMA Tokens & NFTs

4.1 Token Nature

TAMA tokens are utility tokens designed exclusively for in-game functionality. TAMA tokens are:

• NOT securities, investment contracts, or financial instruments
• NOT guaranteed to have any monetary value
• Subject to market volatility and regulatory risks
• For use within the Solana Tamagotchi game ecosystem only

4.2 NFT Ownership

NFTs minted through our Service are on-chain digital assets on Solana blockchain. By minting an NFT, you:

• Own the NFT as a digital collectible
• Receive gameplay utility (earning boost multipliers)
• Can transfer, trade, or sell the NFT on compatible marketplaces
• Understand that NFT prices are determined by market forces and may fluctuate

4.3 No Guarantees

We do not guarantee, represent, or warrant that:

• TAMA tokens will have any specific value or price
• NFTs will retain or increase in value
• You will earn any specific amount of tokens through gameplay
• The Service will be available without interruption

5. Prohibited Activities

You agree NOT to:

• Exploit Bugs: Intentionally exploit software bugs, glitches, or vulnerabilities for personal gain
• Automation: Use bots, scripts, or automated tools to interact with the Service
• Multiple Accounts: Create multiple accounts to circumvent referral limits or game mechanics
• Market Manipulation: Engage in price manipulation, wash trading, or other fraudulent trading practices
• Scams: Engage in phishing, impersonation, or other fraudulent activities
• Illegal Activities: Use the Service for money laundering, terrorism financing, or other illegal purposes
• Reverse Engineering: Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Spam: Spam, flood, or harass other users

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of tokens/NFTs, and legal action.

6. Intellectual Property

6.1 Our Rights

The Service, including all content, features, functionality, logos, trademarks, and software, is owned by Solana Tamagotchi and protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Rights

You retain ownership of:

• NFTs you mint or purchase (as on-chain digital assets)
• TAMA tokens in your wallet (as blockchain assets)

However, you do not own the underlying game mechanics, artwork, or intellectual property associated with the Service.

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Limitation of Liability

We are not responsible for:

• Loss of tokens or NFTs due to user error, wallet compromise, or blockchain issues
• Service interruptions, downtime, or technical failures
• Market volatility affecting token or NFT prices
• Regulatory changes affecting cryptocurrency or blockchain gaming
• Third-party services (wallets, exchanges, marketplaces) we integrate with

Your use of the Service is at your own risk. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

8. Indemnification

You agree to indemnify, defend, and hold harmless Solana Tamagotchi, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of any third-party rights

9. Termination

9.1 By You

You may stop using the Service at any time. However, tokens and NFTs on blockchain cannot be deleted and remain on-chain.

9.2 By Us

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Any reason we deem necessary to protect the Service or community

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. However, your on-chain assets (tokens, NFTs) remain in your wallet and are not affected by account termination.

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with international commercial law and blockchain technology principles. The parties agree that the decentralized nature of blockchain technology and the global accessibility of the Service make traditional jurisdictional frameworks less applicable.

10.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Good Faith Negotiation: Parties will attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes shall be resolved through mediation
3. International Arbitration: If mediation fails, disputes shall be resolved through binding international arbitration in accordance with internationally recognized arbitration rules

You waive any right to participate in a class-action lawsuit or class-wide arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Notifying users via Telegram bot or email (if provided)

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
